| The Baltimore County zoning code contains a number of regulations that have an impact on the development and maintenance of affordable housing. Section 305 allows owners of damaged or destroyed dwellings that do not comply with height or area requirements to be restored. The area or height deficiencies cannot be increased beyond that which existed prior to the damage, and other limitations apply.
The county regulates trailer parks (sic) in Section 414 of the zoning code. The county does not allow any trailer parks on less than five acres of land. Each trailer pad must have at least 3,000 square feet and must contain sewer, water, and electricity. No trailer can be located within 100 feet of a road or street and no closer than 20 feet to any other trailer. Other regulations apply
The county’s growth management ordinance is found in Section 4A00. According to Section G, no building permit or final subdivision approval can be granted unless the county issues a reserve capacity use certificate for the development. The city may authorize development only to the extent that the impacts will not exceed public facility standards. The county can issue a certificate even if the standards are exceeded if there has been substantial recent development of facilities or the developer commits in writing to making improvements to existing facilities.
The county allows home occupations which it defines as use that is incidental to the use of the building as a dwelling. The county regulates the home occupation by allowing only one person to be employed on the premises other than immediate family members, and no commodities are kept on the premises. The county identifies fortune telling as a use that is not a home occupation.
The county allows ‘as-of-right’ single-family detached, semidetached, or duplex dwellings in all residential zones, subject to certain restrictions contained Section 402 (Section 1B01). The county, subject to a hearing officer's findings of compatability, allows group houses and multifamily buildings in certain residential zones. Section 1801 C 11 contains specific additional allowances for home occupations for those with disabilities.
