Description The New Orleans Zoning Code contains a number of provisions that impact affordable housing in the city. In Section 4.1.3 the City permits home occupations, servant’s quarters, small group homes, conversions of second floor space, trailer parks and restoration of non-conforming uses. The city allows home occupations in the most restrictive residential zone if it occupies no more than 15 percent of the floor dwelling of the unit and no person not a resident is employed in the business. The code also limits the type of home occupation to those similar to art studios; dressmaking establishments; professional offices; and teaching facilities. The code does not allow barbershops, beauty parlors, restaurants, or doctor’s or dentist’s offices to be considered a home occupation. The code also allows group homes for up to six residents if the home is not located within 1,320 feet of another existing home. (Section 11.22) In Section 10.12.1, New Orleans allows certain second floor parts of non-residential structures to be converted to residential use. The City regulates trailer parks and trailer courts in Section 11.39. While allowed, each park must contain at least two acres, contain no more than 24 sites and provide that each space contain at least 1,750 square feet. Several other sections regulate access, yards, off-street parking, and signage. New Orleans also allows nonconforming uses to be restored if destroyed by fire, storms or other acts without regard to the amount of damage incurred. (Section 13.3.1)
